Job Details

We are seeking a skilled Attorney with 4-7 years of experience to join our legal team. This role will focus on supporting the company's credit and collections operations, managing bankruptcy-related matters, and mitigating financial risks associated with customer insolvencies. The ideal candidate will have a strong background in commercial litigation, bankruptcy law, and creditor rights, as well as experience in working within a corporate environment, preferably in the healthcare or pharmaceutical industry. Candidates must possess not only business savvy, but be able to manage projects, and provide strategic counseling to join the high-performing, collaborative, and growing Legal team.

Key Responsibilities:

Bankruptcy

  • Analyze and manage customer bankruptcy filings, including Chapter 7, Chapter 11, and Chapter 13 cases.
  • Represent the company in bankruptcy proceedings, including filing proofs of claim, attending court hearings, and negotiating settlements.
  • Collaborate with internal teams to assess the financial impact of customer insolvencies and advise on risk mitigation strategies.

Credit and Collections

  • Provide legal support to the company's credit and collections teams, including reviewing and drafting demand letters, payment agreements, and collection strategies.
  • Negotiate payment plans and settlements with customers to resolve outstanding balances while protecting the company's interests.

Litigation and Risk Management

  • Manage commercial litigation matters related to credit and collections, including breach of contract claims and enforcement of judgments
  • Evaluate and pursue legal remedies, including garnishments, liens, and other creditor actions.
  • Collaborate with external counsel as needed to ensure effective representation in complex matters.

Legal and Regulatory Compliance

  • Ensure compliance with applicable bankruptcy laws, credit regulations, and collection practices.
  • Monitor changes in laws and regulations that impact the company's operations and advise on necessary policy updates.
  • Provide training and guidance to internal stakeholders on legal risks and best practices related to credit and collections.

Education and Experience

  • Juris Doctor (JD) degree from an accredited law school.
  • Active bar membership in good standing in [Insert State].
  • 4-7 years of experiencein bankruptcy law, creditor rights, and commercial litigation, preferably within a corporate or healthcare/pharmaceutical environment.

Skills and Competencies

  • Strong understanding of bankruptcy laws.
  • Experience in managing credit and collection matters, including negotiating settlements and payment agreements.
  • Knowledge of relevant federal and state regulations, including FDCPA and UCC (Uniform Commercial Code).
  • Excellent legal research, drafting, and analytical skills.
  • Strong negotiation and communication skills, with the ability to work collaboratively across departments.
  • Ability to manage multiple priorities and deadlines in a fast-paced environment.
